1. Acceptance of Terms

By downloading, installing, accessing, or using the Mesh Football App, you agree to comply with and be bound by these Terms and Conditions. Mesh Football is a chat application designed for football players around the world to connect, organize games, join teams, and communicate with fellow players.

If you do not agree to these Terms, you must not use the App and should uninstall it immediately.

2. Description of Service

Mesh Football provides a platform that enables users to:

• Create and manage user profiles with football-related information
• Create, join, and manage football teams
• Create, discover, and join football games in their area
• Communicate with other players through team chats and private messages
• Rate and evaluate other players' performance
• View and share location-based information about games and venues
• Receive notifications about games, messages, and team activities

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and truthful

4. User Accounts

4.1 Account Creation

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4.2 Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

5. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates any applicable law or regulation
• Harass, abuse, threaten, or harm other users
• Post, upload, or share any content that is illegal, offensive, defamatory, discriminatory, or violates others' rights
• Impersonate any person or entity or falsely state your affiliation with any person or entity
• Interfere with or disrupt the App or servers connected to the App
• Attempt to gain unauthorized access to the App, other accounts, or computer systems
• Use automated systems (bots, scrapers) to access the App without permission
• Collect or harvest information about other users without their consent
• Upload viruses, malware, or other harmful code
• Spam other users with unsolicited messages
• Use the App for commercial purposes without our express written permission

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of any content you post, upload, or share through the App (including messages, photos, and profile information). However, by using the App, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of operating and providing the App services.

6.2 Our Content

The App, including its design, features, logos, and all other content, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without our express written permission.

6.3 Third-Party Content

The App may contain content from third parties, including other users. We are not responsible for the accuracy, legality, or appropriateness of third-party content.

7. Player Ratings and Evaluations

The App allows users to rate and evaluate other players' performance. You agree to:

• Provide honest and fair ratings based on actual game performance
• Not use the rating system to harass, bully, or discriminate against other users
• Accept that ratings you receive are the opinions of other users and may not always be accurate
• Understand that we are not responsible for the accuracy of ratings provided by other users

8. Location Services

The App uses location services to help you find nearby games and venues. By using location features, you consent to the collection and use of your location data. You can disable location services at any time through your device settings, though this may limit certain App features.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Any defects or errors will be corrected
• The App is free of viruses or other harmful components
• The results obtained from using the App will be accurate or reliable

We are not responsible for the conduct of any user, including but not limited to:

• The accuracy of information provided by users
• The safety or quality of games organized through the App
• Injuries or damages that may occur during games or activities organized through the App
• Disputes between users

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any conduct or content of third parties on the App
• Any unauthorized access to or use of our servers or your account
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code that may be transmitted through the App
• Any injuries or damages resulting from participation in games or activities organized through the App

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

12. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Any content you post, upload, or share through the App

13. Modifications to the App and Terms

We reserve the right to:

• Modify, suspend, or discontinue the App or any part thereof at any time
• Update these Terms from time to time
• Add, remove, or modify features of the App

We will notify you of material changes to these Terms by posting the updated Terms in the App. Your continued use of the App after such changes constitutes your acceptance of the modified Terms.

14. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the App will immediately cease
• We may delete or anonymize your account and data in accordance with our Privacy Policy
• All provisions of these Terms that by their nature should survive termination shall survive

You may terminate your account at any time by deleting it through the App settings.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent French courts, in accordance with the laws of France.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms or our rights and obligations hereunder without restriction.
